I'm not certain whether some cultivars of Autumn Olive are more invasive than others, but one particular issue with this cultivar is that it produces more berries and larger berries than other cultivars. Since autumn olive spreads through wildlife, more attractive, abundant fruits will lead to an increase in the spread of the invasive.
Nothing in the description of the cultivar suggests that the seeds are infertile, but even if they are claimed to be, it can be only a matter of time before that is worked off (as some ornamental plants have escaped in the past). Just because it isn't considered invasive right now, doesn't mean it won't be invasive in the future. Not sure what can be done in VA about this cultivar, however.
